Can they really ask this?????

Positive discrimination does get people's hackles up. We had a disabled applicant for a teaching post a couple of years ago who insisted he had a right to an interview, and was most impolite in doing so. He wasn't actually qualified for the post - he couldn't have been legally employed - so an interview would have been a waste of everyone's time.

 

When he phoned and was told why he would not be interviewed, he threatened to take us to a tribunal (which never happened; he must have realised he had no case).

 

The legislation does a good job in ensuring disabled candidates get a fair chance at interview, rather than being screened out at the application stage because the employer incorrectly assumes they can't do the job due to their disability. Like many things though it can be taken too far!
