ClaireG
Do any of you know about data protection? We were due to move into a rental property on the 10th feb and still havn't moved in due to work being outstanding. As advised by the agents we looked for an alternative property. We were told by the agents that another agency would probably be able to use the reference checks etc that had already been done on us. I viewed another property on Thursday and we decided to take it. I phoned the agency of the house we were supposed to move into and asked them to fax our refrences etc to the new agent. Today i emailed the new agent to see if this had been done. They hadn't received anything so i contacted the orginal agency to be told that they can't fax the info due to data protection. I asked if i could go to the office and get the refrence or a copy and was told that they couldn't be seen to be giving me this info. I am . They were the ones who orginallyt suggested another agency could use this check. Also don't we have a right to information held about us? Can they refuse to give us this information? bluekarin
According to http://www.ico.gov.uk/Global/faqs/data_protection_for_the_public.aspx#f112F5F72-814E-4AAB-839D-4874380E03C2 Q: An organisation is holding information about me. How do I get it? If you believe an organisation holds personal information about you, you can ask them to provide you with a copy. In order to do this you will need to: make your request in writing (email is acceptable), clearly explaining or listing the information you want; keep a copy of this request for your records. If you need to make a complaint to us at a later date we will ask you for a copy of your original request; we would also recommend sending your letter by recorded delivery so you can be sure of its safe delivery. So I think you are within your rights to have that information they are holding. That estate agents have caused you nothing but trouble. I really hope you get moved, and away from them as soon as possible. Especially considering the reason you are moving is for your health! They aren't helping very much on that front
ClaireG
Thanks The sooner we can be done with them the better! We just need this reference check of them. I will try emailing them with that link and quote and see what response we get.

chickenNutter
Claire, If you have given permission for your data to be given to someone else then Data protection doesn't come into it. I think they were just being obstructive.
ClaireG
Obstructive is the polite word for them I know estate agents don't have the best name anyway but this lot did them no favours! Luckily the ones we are dealing with now are much more professional and helpful.
