anyone know the procedure for divorce in Scotland???

Hi, my ex and I have mutually agreed to divorce after a years separation. we filled in the form to send to the sheriff court online as they were in his name he is technically divorcing me, so I signed the consent section and they were posted off along with the court fees.

 

Does anyone know what happens next???

 

The online company we used said it should take 6-8 weeks in total.

 

So far it has been 4 weeks since posting the forms and the fees have not been cashed and we have not received a decree nisei yet... am assuming we will as online i found information saying you receive that first then you get a decree absolute (at which point you are divorced)... but to be honest I haven't got a clue what should be happening when or how long it should all take

 

Sorry it's not the best topic to post just wondered if anyone could give me any info as starting to wonder if the forms have just been lost

Good luck with it all chicken little - you are probably right, it will be sitting in someone's "to do" tray. I wouldn't worry though as it is usually very straightforward if mutual. My ex and I (also Scotland) did a few years back though to be honest I can't recall all the ins and outs (for example I can recall getting a decree nisi but can't remember decree absolute though know I am definately divorded as this was checked by lawyer when my longterm partner and I adopted recently). I remember thinking it must be more complicated than it seemed and kept expecting something to go wrong, but it didn't. All the best to you - if they won't speak to you to let you check up on it get your ex to do so.

Thanks SAB, I just don't know what should happen I guess that's the problem (i like knowing what's going on), read about the decree nisei etc when doing online searches. Hopefully it will all get sorted out on Monday and as you say if they wont speak to me I can ask him to contact them.

I know... i've been having a right old rant to my friend. Apparently if we reapply for the divorce then I drive up next week I can waive the notice period so that will hopefully speed things up a bit... now the credit card company have lost my certified copy of my deedpoll name change and after being given the run around i got put through to a customer complaints person who seemed to be telling me off for complaining... today has been :wall::cry:
