Redundancy & Consultation Period

Recommended Posts

Does anybody know anything about the rules of redundancy.

If you are three weeks into the "consultation period" can you be served Notice of Redundancy before the consultation period ends. According to a letter "Consultation" was expected to end at the end of October. If they issue Redundancy Notice before the end of the consultation period - when does 12 weeks notice start from - when notice issued or when the end of the consultation period was supposed to be?

Hope this makes sense - its doing my head in.

From my recollection of being in a similar position, I think it has to be 12 weeks from when the consultation period was supposed to end; but issuing the notice before the end of the consultation period kind of makes a mockery of the consultation period, I would have thought :?:

Hopefully someone who knows for sure will come along. If not, and your HR dept can't help, perhaps the good old CAB may be able to help?

I was recently made redundant.

As I understand it, where a company is making more than 20 people redundant, a consultation period must be applied. My consultation period was one month.

During the consultation period I was given access to a career management consultant, who helped me with my CV, and I was allowed time off for interviews.

My notice period started at the end of the consultation period.
