Chickendoodle Posted January 5, 2011 Share Posted January 5, 2011 I will try to make this brief My YD left her flat in May and moved to a new flat. The letting agents were always rubbish and she didnt expect to get her deposit back quickly so let it slide a bit. She got a call in November (6 months after she left) saying she owed £200 odd for repairs, on top of the £600 deposit which they had kept. The deposit was with a protection scheme but when she rang them they said they had done everything properly and realeased the money to the agents as she had not replied within 14 days to a letter they had sent, allegedly to my adress but which never arrived!!!!!!! So much for protection! She has been asking the agents repeatedly for evidence as to why they reckon she owes £800 and a pack of information arrived today. She had asked how much depreciation they had taken into account as the majority of the cost was a replacement carpet and they have ignored this completely and just sent a copy of the original bill in 2006 and a slip from them (not an invoice from a carpet company) for the replacement. The original carpet was only £6.99 per metre so was not top quality and looking at a few sites they reckon after 4 years this would be pretty much at the end of its life. So, my question is not if my YD is in the right (which I know she is) but where does she go from here to get her money. The tenancy deposit protection agency dont want to know. Does she use the small claims court or would it be worth contacting a solicitor. Obviously in view of the amount involved she will not want to pay huge fees to a solicitor which will wipe out what she is due Quote Link to comment Share on other sites More sharing options...
bluekarin Posted January 5, 2011 Share Posted January 5, 2011 My first port of call would be CAB. They can then put her in touch with a solicitor, if she doesn't have one already. Letting agents are such...can't say what I'd like, but you know what I mean. I'd recommend the legal one first, and someone may direct you to the properties board.
