Keeping on the right side of the law

Hello - I am really keen to keep 3 hens in my garden. However, the other day at work a colleauge mentioned about by-laws and that they need to be a certain distance from the house. Can anyone help me? I can't see anything in my house deeds or charges register, nor my local council (Sandwell) web-site. Can I keep hens in my garden? Are there regulations? My garden is really long and there's plenty of space - so no welfare issues.

A good question Mark, oh, and welcome to the forum! :D

I think if it doesn't say on your deeds that they are prohibited, then you are in the clear for getting chickens! :dance:

No doubt somebody else will be along later with a better insight into this though!

I cant imagine it causing any issues. :?

 

If your house is freehold then i dont see any problems, this may be different if you rent or have a leasehold property with specific restrictions within the deeds.

 

Im sure someone will be along soon who can give you more information on this. :D

Something about not being allowed to keep them near to the house might be a local by-law rather than in your deeds. I've never heard of it and I hope we haven't got one because my chicken run is attached to the house! :D

Welcome to the forum. I've never come across such a by-law, and I would be surprised if a local authority had bothered itself with things like that. If there are no restrictions in the title to your property, which are usually set up when the house is first built, then I wouldn't think there is any problem.

 

These are just pets, after all. "Ooops, word censored!"ody ever says you shouldn't keep guinea-pigs or rabbits in the garden - but people are remarkably uninformed about chickens, and seem to think that special rules apply. I had people telling me I wouldn't be allowed to keep them because of noise/health reasons etc. or asking if I'd had to get a licence!

 

Give your local authority a ring on Tuesday to check, and then get on with ordering your Eglu! (and come back and tell us what colour, and what sort of chickens ... :wink: )

Thanks guys for your help, I've checked through the deeds and nothing in there so just going to get on and buy the hens now! If for some reason there are any objections then they can live on the allotment as the person I share an allotment with also has chickens!

 

Just bought a book this morning written by the makers of eglu and am all raring to go! A friend is building the house for us, so unfortunately no funky eglu here, and once thats built we then have to decide what hens to get and buy all the stuff that goes with it! Can't wait - should have it all in place by mid June!
