wee_deec Posted November 22, 2011 Share Posted November 22, 2011 Folks, I need to do some digging around to try and find other local authorities that permit allotment holders to keep chickens. I have already submitted an FOI to all the Scottish LA's. The more information I have the better case I can make for my local authority to adopt such a policy. If you could either post here or PM me the following information: Which local authority you have an allotment with and if you have a copy of the policy etc that would be great. ohcarolina Posted November 22, 2011 Share Posted November 22, 2011 I have an Allotment in Crawley, West Sussex. I have written permission from them to keep chickens on the site (will move some there in Spring to clear it). The only restriction is the size of accommodation - no more than 6 X 4 feet but many plot holders have bigger sheds and greenhouses so I'll chance my arm with a Classic & run. The details are in the paper agreement and don't seem to be available on line but I'll happily scan and forward to you if you PM an email. House MD 221B Posted November 25, 2011 Share Posted November 25, 2011 I shall try to find the relevant legislation to back this up, but my partner and I looked this up, and the Isle of Wight Council doesn't allow it, HOWEVER, we found legislation that stated that council's cannot prohibit it, and it is perfectly legal. However I shall try and find it to provide the link to it. However even if the law is correct, the council may challenge it anyway and it may cause you extra hassle and strife than you may wish. best bet is to contact your council to find out what their requirements are, BUT also do some googling and searching for the legislation because I'm sure they can't stop you. For Scottish legislation please click here. The Allotment Act 1950 includes the allowance of certain forms of livestock (hens and rabbits) to be kept although this can be, in some cases, restricted by local by-laws. A council may have local rules to specify that no livestock or hens are allowed. It can be disheartening to be at logger heads with a local council but you do not need to ask for permission to keep hens on an allotment – it is an entitlement and part of what allotments are all about. Sometimes councils believe they have the right to tell allotmenteers what to do just because they are the council. Not true. Unfair Terms in Consumer Contracts Regulations 1999 makes a council's ability to impose arbitrary rules unfair and hence unenforceable. Hens can be kept on Council owned allotment as a right. sjp Posted November 26, 2011 Share Posted November 26, 2011 Sandwell allow chickens on their sites and quite a few have got chickens the site were I'm Chairman although is council owned is an assosiation run site as are nearly all the sites in Sandwell We don't have chickens on here and although We can't stop members keeping them what We tell new members is that We'd prefere that they didn't keep them on site due to the fact that the site has been subject to a few breakings in the last 2 or 3 years we due have a fox den on site but mainly that up untill the present committe took over we had a terrible rat problem that is only just under control we also have mice that are so far proving harder to get under control has they wont take the bait We also have one or 2 plot holders that would in all likely hood be a problem but that another story that is not for a printed conversation all that said at the end of the day I anybody did want to keep chickens on site the advice I got from the former allottment officer was that we had no right to stop them as long as they kept them to an acceptable standard Quote Link to comment Share on other sites More sharing options...
