I recently took my EX Employer to an Employment Tribunal for Disability Discrimination and Won my Case on 5 counts one of which was direct discrimination by the HR Manager! even though it took 2 years to finally come to court. I represented myself against 1st there top Employment solicitor and then Top 3rd Barrister in Country. I am not a believer in this abulance chasing sue sue culture we are adopting from our US neighbours but sometimes you just have to stand up for your principles in this case I had developed RSI and Tenonsynovitus (industrial Injury) they tried to force me out by making me jump through hoops then making life hell and still I wouldnt go, they gave out new posts I could have done on the QT hoping I wouldnt find out but did. They lied under oath destroyed important and damning documents, plus a whole host of other spiteful nasty deeds. The upshot is I have just learned they spent £65,000 in Legal Expenses defending my claim I got £8,000 in injury to feelings for 5 counts of discrimination I have virtually no chance of finding a job due to my disability and also that I took them to court & Won Where is the justice in that !! I bet you would have accepted the £65k at the outset and saved yourself an ordeal, and them a thrashing. Well done for showing bosses that they can't do the dirty on folk and get way with it. The HR Manager a real "Hateful/Spiteful/Vindictive" woman would send anyone who threatened to take the company to tribunal a letter stating that "If the Employee lost the tribunal hearing the company would also charge the employee £50,000 for the companies legal fees". This nearly always led to the Employee dropping their claim, it was a risk the employee couldn't take and led to the company never receiving adverse publicity and saved the company thousnds of pounds. keyhole kate Posted June 17, 2008 Author Share Posted June 17, 2008 I had just got on with my work over the years (17) kept myself to myself was conciencious about my work didnt get involved in all the petty squabbles and backstabbing but when I decided to take a stand everyone turned on me even people I had worked alongside day in and day out sides were drawn but still I wouldnt leave in the end they dismissed me on ill health capability and said there was no redeployment oppertunity all lies Hr Manager even had my personal file delivered and left on my doorstep when I requested a copy! (just one of many instances of her spitefullness She came unstuck when telling me in front of my Unison Rep that I ciouldnt do a job I suggested would have been a suitable alternative if I had been offered it and then went on to say it was also my line managers opinion and that of the succesfull post holder I got a judgement against her for Direct Discrimination. As for the papers they wouldnt touch my story not even the News of the world as one of the Trustees on the board oh did I mention I worked for a Charity (definately didnt begin at home) obviously called in some favours. I am so glad I am out of it but dont know what to do with myself these days having worked since 16 and now 48 I am a great believer in what comes around goes around all the Employees are terrified to say or do anything so just let them walk all over them. I have always loved making things (sewing) so I am going to have a go at making some craft items ( watch out Fleabay) such as Chicken (obsessed) and Cats (also obsessed) doorstops, shelf sitters that kind of thing just to keep me from going comepletly insane and to give me some value of worth now I cant keyboard for as long or at speed the way I used to Thanks for all your support and thoughts!
