Prank callers - how can I find out who it is?

Recommended Posts

but the officer I spoke to was downright rude & I don't think I deserved that.

No, there is no need for the officer to be rude, he should be polite and professional at all times.

But, this is not harassment (I think), as harassment is only when:

"Intentional harassment, alarm or distress.

(1)A person is guilty of an offence if, with intent to cause a person harassment, alarm or distress, he—

(a)uses threatening, abusive or insulting words or behaviour, or disorderly behaviour, or

(b)displays any writing, sign or other visible representation which is threatening, abusive or insulting, thereby causing that or another person harassment, alarm or distress."

(Section 154, Criminal Justice and Public Order Act 1994)

But do keep a log of events, as it may come in useful.

The law relating to harassment is much broader than the words Fred quotes in the Criminal Justice and Public Order act. The best source is the Protection from Harassment Act 1997

Two relevant quotes are:

'“harassment” of a person includes causing the person alarm or distress; and

a course of conduct must involve conduct on at least two occasions.'

'the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.'

So essentially if it causes you distress, there is more than one incident and reasonable people in possession of the same info think it sounds like harassment, it is.

It may be there is an entirely reasonable explanation, but it's really hard to see what that could be  so the obvious conclusion is someone is doing this to annoy/upset you.

Sounds like you were unlucky in who you got at the police office. It may be that you need to appear more visibly upset by who might be behind it and what they might do next.

I get very few calls from P.P.I. companies and that sort of thing, and yet still I find them irritating and at times inconvenient. I feel for you Sarah, and I find it sinister, particularly if the same person went to the trouble of actually going to an estate agents.

I don't find this amusing at all.

Be careful, if a certain type of person gets wind that this is bothering you, they may find it amusing to add to it, even if it wasn't anything to do with them in the first place.
