I didn't end up getting my chooks from there because there was a breeder a few miles away from me, but Storrs were very good. Their chooks were well looked after and the young chap who showed us around was very knowledgable and was happy for us to handle a couple of chooks too. TAJ Posted February 16, 2008 Share Posted February 16, 2008 Having had such convenants at our previous house some were for 10 years and others 25 years - such as not enclosing the front garden. The legal advice was breaking a concenant is civil not criminal law - so it would be up to an individual (or the developer) to sue you. The feeling was the developer may get involved to protect an estate whilst still building, but would not be interested in doing this later. Having not really gone public with neighboughs on our chooks they have just come out with a ladder to cut down a tree and were looking over the 6ft fence down on the cooks who were then very noisy as she was scarring them! lozkate Posted February 16, 2008 Share Posted February 16, 2008 Not something I always live by (but sometimes apply when I've been down the pub for too long) is........ "its easier to ask for forgiveness than to ask for permission" I think this was alluded to in an earlier post. I've posted before on the subject of covenants having done a bit of stuff in taking loan securities for banks. They're odd things usually placed for either the interests of the vendor/developer or local community. Who ever is 'selling' has an interest to endear itself to the locals (and the planning chaps) - imagine Barrats throwing 27 houses on your local park and you get the deal here. If they throw a bit of money at the legals (just the easy stuff like covenants) its good for them. There's also a business reason in as much as there is a reputational risk for the developer. If their development turns into an urban farm, caravan park or a light industrial estate it doesn't look good for them the next time they come round to developing a bit of the council's newly created brown field (usually from green belt but that's another story). If they've been generous with the garden (i.e. you have as much floor space as you have on the ground floor of your house!!!!!) then you can see that there might be potential for the developer's reputation to be tarnished. For the record, I acquired the 'right' to 'erect' (love it) a 3' fence around the front of my property which was in direct contravention of a developer-imposed restriction. This 'permission' was issued by the town council and delivered to me with the deeds. I wonder whether the local council might provide clarity but i'd refer you to the above quotation for balance! Having just read what I have written I can not believe that I intimated that the council might 'provide clarity'. Apologies for anyone who read that and is unable to stop laughing!!
