And yes, there is a contract between you and them A contract is: 1. an intention to create legal relations 2. offer (the hens) and acceptance (your order) 3. consideration (in this case payment) If one party fails to act as promised, and the other party has fulfilled the duties under the contract, the other party is entitled to legal relief. It doesn matter if the contract is written or oral A breach of contract is a failure to fulfill the duties under the contract terms. A contract can be breached in the following ways: One party does not perform as he or she promised One party does something that makes it impossible for the other party to perform the duties under the contract One party makes it clear that he or she does not intend to perform the contract duties Damages for Breach of Contract When one party has breached the contract, the party who has performed is entitled to various remedies for the breach. Consequential damages – This requires the breaching party to pay the non-breaching party an amount that puts the non-breaching party in the same position they would have been in if the contract was performed Nominal damages – This is a minimal amount provided to the non-breaching party if that party won the case but did not financially lose much Other Remedies for Breach of Contract Specific performance – A court can require the breaching party to perform their duties under the contract. This is afforded for unique circumstances. Rescission – A court can pretend like the contract never existed. Here, neither party would be required to perform the obligations under the contract. If there has been performance by one party, the court does its best to put that party in the same position he or she was in before the contract was formed. Don't wish to change the subject, but (briefly) we are owed £120 by a septic tank emptying company who emptied the wrong house's tank! We have phoned, written letters and even sent a solicitor's letter, demanding the money back. Nothing. Can't afford to spend more on solicitors at present. Its infuriating. Won't go to small claims court: Not a large enough sum! I think your best course of action ladies is to weild the consumer power of having the ability to discredit their reputation. Let them know what forums and magazines you subscribe to and what you are planningon tellign everyone. Are Omlet recommending them as a supplier? We will never deliver anyone else's birds I would wipe the hen house floor with them, contact and their agents and ask if they have had problems. What happens when you call them? We ordered 8 chickens in February ............ 3 were supposed to be delivered at the end of April - they weren't. I eventually phoned to ask and was told they'd had problems with that particular batch of Copper Blacks. The remaining 5 were due to be delivered at the beginning of July. I've heard nothing from them and when I phoned this morning, I only got the answer machine I've tried their number this morning Lesely and it's not recognised and they say they do not deliver less than 50 birds at present on the website: Regrettably we are unable to deliver orders under 50 birds at the moment. I have spoken to him twice befor ena dhe has been friendly. Today he just told me to phone the office line and didn't remember who I was He sounded very fed up. I phoned the office - and a person answered It was Darren and he was really helpful. There has been a problem with obtaining the Sapphires and they won't be available until September. We can have the 3 Copper Blacks - but sold 'as seen' because of the pecking problem they had. We can also have 3 Jasmines. Darren did say that they aren't taking any orders for Sapphires and aren't taking small orders until the problems have been sorted out. It sounds hopeful - we will wait to see what happens next week. I'd heard nothing by Thursday so I phoned and left a message - no reply. There was no message for us on Saturday about delivery for Sunday either. I phoned on Monday and left a message - my call wasn't returned. I have now emailed to cancel my order and to ask for my deposit back - I'm not too hopeful of that happening either. Luckily it is only £20 - but I don't really want to lose that. We bought new chickens from our Meadowsweet agent... 1 Bluebelle 3 Heritage Skylines 2 Daisybelles and 2 Rhodestar A mixture of cream, blue, and brown eggs. You have to contact them via a form you fill in online and then they get back to you With my web designer's hat on, I have to point out that there are practical reasons for using a form - for starters, it means spam merchants can't just grab your (the website owner's) email address from the page (I had to stop using an address I'd published on my own site as it attracted about 99 spams for every genuine message ). For some sites, a good form can also help/encourage your customers to provide useful information or contact the correct department. All that the vast majority of those forms do, in any case, is put together a normal email and send it to the company, just as if you'd written it in Outlook on your PC. If it's not answered, that's the fault of the people at the company, not the website.
