Janty Posted August 30, 2009 Share Posted August 30, 2009 (edited) Aggggghhhhhhhhhhhhhh! We haven't sold a lot on ebay but we recently sold our old car. I listed every fault no matter how tiny and it sold. The person collected it Friday evening. After taking it for a test drive, he said that he was really pleased with it and bought it. I got a really stinking e-mail today through e-bay listing a load of faults and stating that he was going to report me to trading standards and ebay, that I had been really unfair not listing the faults, etc. He said that he was awaiting my response before reporting me. I have e-mailed him back saying that I was genuinely unaware of a problem with the clutch (which I was) and that regardless of his threats, I was really unhappy that he had had such a bad experience. I offered to refund him totally for the car if he contacts me today or tomorrow and returns it. Does this seem fair? I hate ebayers like that We sold a car a few years ago on ebay, only for the winning bidder to not even contact us and then became unregistered! We sorted it in the end and finally sold it to a lovely couple a little while later. I would be very polite when replying so he can't use anything against you and just point out that he was very happy when he test drove the car and didn't say that anything was wrong with it. He's probably gone over the whole car with a fine tooth comb after finding a small problem with the clutch and then listed everything he can find at fault. Did he pay you through paypal? Don't let him bully you. When it comes to transactions between private individuals it's a matter of "buyer beware", trading standards are unlikely to be interested. The only problem would be if you had deliberately lied, eg "This clutch is brand new, I only fitted it last week" when that wasn't the case. If he had an issue he should have raised it then & before he paid you for it You don't need to do anything - he checked it & was happy enough to pay for it & drive it away,wasn't he? Guest Posted August 30, 2009 Share Posted August 30, 2009 Um for a second hand car I would say bought as seen if he wanted a new car he shouldnt have even bought a second hand one Also to buy one of ebay without seeing prior to bidding l I dont think he would have any redress at all Also I would be reluctant to give him his money back as he may have meddled with it himself now! If you have offered him a refund then it shows that you are upfront and honest in my opinion. If the clutch was such a problem he should have been able to detect this on his test drive. Good Luck. Janty Posted August 30, 2009 Author Share Posted August 30, 2009 Latest nasty message : I just looked at your advert and the faults were not mentioned, speedo, gauges etc. also I forgot to mention the back window doesn't work and the rust is definately not just on the wheel arch, I'd love to accept your refund but this leaves me losing out on over £100 with the insurance company so this will not be acceptable. I was not threatening you by the way, its just if I get the work done and take receipts to trading standards they assure me you are responsible for the costs. Why can't people just be honest? My reply : Once again, I sold the car in all honesty. I genuinely did not know there were any other faults. That is why I have offered a full refund. You will be ok with the insurance as they have a 14 day money back policy by law. I think the simplest thing is to claim your money back through the insurance and we will give you a full refund. I have not sent off the DVLA forms yet as I didn't want them sitting in a post box for the weekend. I have just contacted Halesworth Police Station regarding this as the car is in limbo at the moment ownership-wise. They have assured me that the simplest option is the full refund and they actually told me about the 14 day money back cancellation scheme with the insurance companies. My friend advised me to report this as there could be traffic offences logged against the registration. If I was trying to be dishonest over the car, I would not have offered a refund. It's a second hand car - a rather cheap second hand car judging by you saying you could s"Ooops, word censored!" it. Trading standards would have a good laugh at his expense methinks. He saw pictures and more info in your listing than he would have done in other places like local papers, autotrader etc. He had a test drive. If he doesn't know anything about cars he should have bought a friend along. He bought it secondhand, as seen. He shouldn't even be offered a refund! The officer I spoke to said that she would put the number to one side and check in a day or so if he's bought insurance. My concern was regarding any traffic offences he may clock up. This all sounds like he's trying it on with you going for a partial refund. It's a private sale ie; you're not a car dealer/trader so it's sold as seen. He hasn't a leg to stand on, the worse thing that can happen is he'll leave you negative feedback on ebay. Have a glass of wine and relax...... I've been on ebay for over 8 years bought 5 cars and sold 3. I've come across someone like your buyer, but my feedback is still 100%. Stick to your guns and stop worrying.
