I'm not sure what the situation is though if the gas safety check isn't done. We will have to see, if they don't let the bloke in to do the check then the gas company might not be happy. Guest Posted October 27, 2007 Share Posted October 27, 2007 I did that when I was chasing last months rent, they never answered the door to the postman and never collected the letter from the post office. This is common with bad tennants apparantly, they won't sign for anything. That's why the law accepts proof of postage as proof of delivery, the courts are aware that it can be impossible to get proof of delivery if the tennant refuses to sign. sparkleeeeee Posted October 27, 2007 Share Posted October 27, 2007 Oh how awful. if they are both unemployed i bet they are claiming housing benifit to pay the rent, dont feel sorry for them, what scumbags!! its you who is going through the financial trouble just before christmas to pay for them. lets hope you can manage to evict them before christmas and dont feel sorry. i have been a tennant in many flats/houses over the years before i could afford to buy a house and the rent and bills always came first. this happened to my step mum. when they moved in with us she rented her lovely house. the tennants were ok for a while then stopped paying and trashed the house and garden. it took six months to get them out and they still owe £2k which they never got back. it cost thousands to sort out. you are lucky that they keep the house nice. houses are a great investment for a pension though. its a shame that some tennants think its ok not to pay the rent. they just assume that you have enough money to pay for them as well. some agents do a contract with the owner that if the tennant doesnt pay or the property is empty the owner still gets the rent. my parents now rent houses by the room so they can keep an eye on things and they dont make such a loss if someone doesnt pay. I know I wouldn't sleep a wink if I thought I'd missed a mortgage payment so I find it hard to understand thsis kinda person. Surely they are committing a sort of benefit fraud if they are taking money for rent and then not paying that rent. Ring the benefits office to check. It might be a no go, but on the other hand..... I know she is a single parent and as far as I know doesn't work but she is divorced so may get some money from her ex which could rule out the housing benefit. Also she was only responsible for half the rent, her brother was responsible for the other half and he was working. Its just the neighbors that think he's moved out. She also had money from selling a property following her divorce. I have an idea that the housing benefit people write to the landlord anyway to confirm details, they certainly have to put details of the landlord on the claim form. Guest Posted October 27, 2007 Share Posted October 27, 2007 He is, now they didn't sign the contract I sent them in August but by making the August rent payment (albeit late) they have legally accepted the contract. The contract was still in both their names and it is there responsiblity to tell me if there are any changes to the contract. He has found my keys to the property and returned them. He also had information as he knows her other brother from the pub (where else). This brother said to him "your ex wife is evicting my sister she has to be out by Monday week" Now Monday week is their deadline to pay before I start court proceedings. Either she is too thick (she really isn't bright) to understand that I would need to take her to court to evict her OR she doesn't want to go to court (maybe she thinks she can just do a runner to avoid the rent - TBH I would then keep her deposit and only be 1 month out of pocket or if I got someone in quick less than a month). Some helpful person said to the brother "she should get legal advice, landlords don't always do stuff right" and about 5 other people, including the landlady said "dont' bother -Dave's wife is clever and she'll have done everything right"! Oh the reason the brother mentioned it to Dave wasn't bitterness, it was becasue my stupid ex asked him to tell his sister that a bank card was due for him from A & L to that addres. Hmmm, it looks like there is something else I will have to deal with and that will be to get the next tenants to start returning any mail addressed to him as "not known at this address". Why he hasn't changed it I don't know, I know his mother gets housing benefit which would stop if he "officially" lived there but I thought he'd moved in with his girlfriend who is not on benefits.... If I've understood correctly your ex mother in law will stop receiving benefit if the tennants forward post, as your ex will officially be living at a new address. Not many well educated people in that pub. I don't know why he won't tell his bank where he is, they had his mothers address before I met him and banks can't pass that data on anyway. He has in the past been out of work and unable to make a claim himself as he couldn't put his mothers address down because if he subsequently found work they could stop her benefit. TBH she would end up homeless if he was "officially" living there because any money he does get goes either in the pub or the betting shop and his mother wouldn't see a penny.
