beeping early morning delivery van

We have a delivery lorry which delivers parcels to a couple down the road who I think are catalogue agents. The lorry delivers nearly every morning at around 6.10-6.20am and reverses outside our bedroom window and uses those annoying reversing beeps :x This is worse now we have our windows open so we are being woken up at that time everyday. Now, I know this is not early for some of you, but for us it is as we don't need to be getting up until 7.20am. Our road is a no through road and we are right at the end of it. Does anyone know if it is possible for these 7 1/2 ton lorrys to switch off their reversing beeps? I have contacted the company in question twice now - they didn't reply to my first message, but I am giving them the benefit of the doubt. I don't want to have to go to the council and tell them about it, as these people need to earn their living. But we also need to be able to have our sleep. I can't talk to the people in question, as although I know them to say hello to, they are quite grumpy and I can just imagine the answer I'd get. Also, I am not brave enough to say anything. If anyone has any suggestions that I've not thought of, I'd love to hear them.

couldnt you park your car in a "difficult" spot, so the wagon couldnt get to your house? if you are at the end of a no-through road, this could be an option.

 

or, could you have a word with the company and ask them not to deliver before half 7?

tempting as it is, we have a roofer who would wake us up with some very loud choice words if we blocked him in :shock::lol: Also, next to our house we have some garages, so thats just not possible. I've messaged the company (can't email them, just use their message page) twice now as they didn't respond to my first message.

I think if the company don't respond to two e-mails, I'd be tempted to either ring or write to them, give them once more chance then write again stating that as you've had no communication with them you feel you have no choice but to speak to the council Environmental Health Dept, noise pollution doesn't have to be constant or at extreme levels, I think it just has to be having a detrimental effect on your life and be unreasonable. Bearing in mind that it's unlikely your neighbours have registered their address as a business premises and therefore probably aren't supposed to be using the no-through-road for daily business deliveries, you could possibly put a note through their door too, just asking if they could either re-schedule their deliveries or have them delivered to a non-residential address.

 

I think the trick is to start off being very nice and neighbourly and if that doesn't work then up the ante! :D

 

Good luck, it's bad enough when my son gets out of bed at 06.30 on a weekend - my neighbours must love him as he runs back up the garden yelling "No eggs yet Mum!!"

:lol: @ your son! So sweet! Why is it kids feel the need to get up early at the weekends? I am having real problems getting mine up week days. Having said that my DS is up early every day, its just the ED who is 12 going on 15 :roll: I'm sure I was never like that when I was her age :anxious::lol:

Didn't you know that getting up extra early at silly o'clock at the weekend is hard-wired into children :?::shock::lol:

 

As for the lorry, then I'd give the company one more opportunity to respond, as per BeckyBoo. Good advice as ever from her :clap:

We live on a main road and are about 100 yards from a Tesco Express and if they were any other 'neighbour' I'm sure I could complain about them being too noisy! Every day they have an articulated lorry deliver their produce and it has a refridgeration unit that humms away for about half an hour every morning. And like you we now we have our windows open and every morning the lorry wakes me up. Very annoying. And yes we were there years before Tesco moved in :eh:

How annoying! - I would def. take Beckyboo's advice.

 

....and don't bother moving to the countryside for peace and quiet.........we're used to our 5 cockerels from 3.30am onwards at this time of year but I'm being woken at 6am by the bird scarer - 3 loud bangs in quick succession....every few minutes :evil: I'm sure when I checked last time that they're not supposed to start until 7am :( Very annoying when you want a lie-in until 7.30 :evil: It's difficult to tell which field the sound is coming from.....

You may have to apply for planning permission if:

 

Your home will no longer be used mainly as a private residence. This is the key test - has it become business premises first and a home second?

Your business activities will lead to increased traffic or parking in a residential area. Your business involves any unusual activities for a residential area.

Your business may disturb your neighbours at unreasonable hours or create other forms of nuisance, such as noise or smells.

Specifically, in the First Protocol, Article 1 of the Human Rights Act 1998 (and common law previous to that), everyone has the legal right to peaceful enjoyment of their own posessions. For noise to become a legal nuisance, it only needs to be unreasonable to the extent of infringing on your "peaceful enjoyment" of your own home. "Reasonable" is a test that, in a court, would be decided by the theoretical "man on the street", who in practice is personified by the judge. Noise pollution is specifically dealt with in the Environmental Protection Act 1990, with noise from a premises being singled out in the article about Statutory Nuisances.

 

I'm not a lawyer, so my feelings carry no real weight, but I'd be surprised if regular instances of noise loud enough to wake you up at a time as early as 6 o'clock or so didn't constitute a nuisance and didn't require those responsible to stop.

 

I'd agree, though, about starting off informally and gently; no-one likes being cornered, so willing compliance is always more likely if you provide your neighbours with a face-saving way out.

Need to look up the bird scarer code of practice - 3 bursts within 30 seconds and no more than 4 times in one hour. Also near to sensitive buildings ( Houses I presume) not before 7 am and not after 10p.m. - we had a neighbour who has one on thier farm land and the people up the road complained - she spoke to me and said someone had reported her and there was nothing to report about - I just told her outright = the bangs go on longer than 30 seconds for the bang and 3 in 30 minutes is not correct but I was not the one to report you I said as I was not. It stopped after someone from the council came out and they were made to stop.

It is worth complaining - it was our dog who hated the thing too - poor dog is not with us anymore.

Thanks Susan - I remember looking it up before we moved here and it was after 7am. I suppose the farmers think that if they can get away with it then they can save more of their crop.

I just need to find out exactly which field it is in.

We were in the exact same situation with a Co-op Late Shop. Being woken by reversing horns and tailgates being lowered at 5.45 am was no joke. The planning permission given before the store opened stated that no deliveries were to take place before 7am but they claimed they were not delivering, only parking and waiting to unload... as if :roll:

 

After a number of emails and phone calls over a few weeks to our local council planning dept about the definition of "delivery" our complaint was upheld and the Co-op received a warning. There has been no problem since.
