My lovely OH has just bought us a cube!! - Update 19/08/11

I am still a bit miffed about omlet's customer service on this one though...

3.1 You must inspect each Item You purchase immediately upon receipt to ensure that it is in accordance with the description provided by the seller.

...

 

 

I think that your seller and Omlet could argue that this wasn't done and therefore you have no comeback. I would put it down to experience and buy the extra bits that you need.

We couldn't inspect it in accordance with the description though, because it was deleted from the server once we clicked 'buy' :?

 

 

And omlet have conceded that they need the advert, so I know the terms aren't 'against' us in this respect.

 

 

And as I've said - we know we're probably not going to get anywhere, but for ME this is about knowing I'm in the right about what we were told we were getting and what we actually got. I know I'm not the only person in the world who would have an insane niggling feeling until the issue was put to bed.

Blimey, i bet your poor old oh wishes he had never bothered! Oh well at least you get the bits free of charge. I am sorry you have had such a bad time with it all, i hope you and your hens get to enjoy the cube in the end. :|

 

 

I know, especially after 2 payments of £450 being taken out. He wondered why the bank was telling him he didn't have enough money for the transaction. His gut feeling was right that he'd paid for it when he clicked buy, but omlet wanted £450 over the phone the day before delivery :?

Was there not a photo with the listing (beforehand) so you could see the condition of the run?

 

 

No, we bought it on the basis that if it wasn't in good condition we'd ask for a refund when we saw it.

 

He's a meat courier so he travels all over with a large articulated lorry - it looked like the cube had been boxed away for a long time. He simply dropped it at our house on his way through our town on another delivery. So no money lost for him to bring it this way anyway.

Am I the only one feeling a little sorry for Omlet in all this? :?

 

Small companies like omlet do not need to be having to give out free items in the climate like it is at the moment, I feel if you buy blind then you take the risk.

No, you are not alone. Even if the ad had not been deleted by Omlet, the condition of the cube would have been subjective. I certainly would not part with that much of my hard earned cash on a second hand item unless I was happy with the condition - or prepared to be disappointed. "if something feels too good to be true...it usually is". Shame that Omlet had to make a loss on this sale :( Very honourable of them.

I don't think it's omlets fault nor squiffs, if you buy a cube with run & extension, you expect to get a fully functional cube with run & extension. I can't see omlet forcing the seller to give a part refund so to keep both parties happy, the easiest option would just be to give the frame. Omlet have a great reputation for customer service so I guess they'd want to keep it up :D

 

Glad all is resolved, cube looks great 8)

I disagree, I feel the blame lies with the buyer and in this case squiff, as to buy blind means you are taking a risk which you yourself have to be responsible for. Whether it had an extension or not is irrelevent, clearly he used it without a support just fine as others have, so he would not have seen any reason to have mentioned anything different would he and therefore I don't feel he did anything wrong, in fact he went out his way to deliver it for a small charge, which a lot of other sellers would not do.

 

Let's hope lessons are learnt all round.

If we're entitled to a return we're entitled to a return, you two are being incredibly judgmental.

 

 

At no point did my other half ask omlet to give us anything for free.

 

And I didn't buy this, my other half did. So I'd appreciate anyone referring to 'my' actions as wrong to reassess their take on the situation, because right now all I'm doing is relaying a situation my OH has found himself in to you in a forum.

 

 

If we spent that much hard earned cash on an item and then asked omlet to see the advert as the item wasn't in the condition originally described and omlet decided to offer to send my OH some nuts and bolts and pole instead of having to reverse the whole transaction because we weren't happy with the product, that's our right as consumers.

 

But we never asked omlet for anything, the reason they offered us the pole etc is because my OH had a meeting with the bank today, in which his bank manager told him he'd had 2 amounts of £450 taken from his account, 3 days apart - when he phoned to ask for the money back, they offered him the pole and nuts etc.

Thanks, it would appear some people think if you buy something secondhand you should expect the seller to mislead you in their description of the item.

 

If this happened on ebay my OH would be fully entitled to an exchange or refund (either by the seller or paypal), and no one in this forum would tell him he should just 'deal with it'.

omlet would not have their buyer and seller protection policies in place if they weren't prepared to use them on occasion, that's the risk you take when mediating online purchases and handling large amounts of money for people.

whether it was your OH or you that 'bought' the item squiff, if was you that posted some very negative remarks.

 

I don't believe its being judgemental at all, it's giving our opinion which is surely what you wanted when you posted?? you didn't expect everyone to agree with you did you? Thats not how the world works is it :wink:

 

I do feel sorry for Omlet as they are obviously caught in the middle and trying to make best of a bad situation, which I give them applause for.

 

Lets hope you can get on and enjoy your cube as they are a fantastic product.
