statutory rights is it covered?

Hi I have two identical M&S sofas one of them seems to have completely sunk at one end. We have swapped cushions about etc and we are now wondering if the frame is broken as the other sofa is fine.

 

We know they are about 2 years old and I will have to have a hunt round for the receipt. But would I be covered in any way to get them fixed? I dont know if its too long a time lapse but would have thought they would have lasted longer at least(they look brand new and we both work full time so its not like they are sat on constantly etc)

 

Any idea if we are under a guarantee? Thank you sorry long posting Donald :lol:

They might be under an extended guarantee depending on the cost of them. I presume you paid with a card rather than cash, in which case you might have more rights via your credit card company. Remember the item must be 'fit for purpose'.

I bought a sofa in March & had to call the company (not M&S) in July as one of the cushions kept literally collapsing in on itself every few days. I reckoned it had been designed badly. A rep came out, did some karate on the flipping thing, said I should do the same to said cushion every day (no! Life is too short!) & then charged me 50 for said advice. I am not impresssed...

I would have thought you would be covered by the Sale of Goods Act as 2yrs isn't a long time for sofas of the quality you expect from there. I bought 2 sofas from them back in 1994 and although I gave one to a charity shop a few years ago when we decided to buy some more up to date ones, we did put the other one in our TV room. Our dog sits on that sofa pretty much all day and I usually sit on it for part of the day too, so it's had daily use for 17yrs and it's still absolutely immaculate. The cushions are still as bouncy as the day I bought the sofa and the frame is absolutely fine. On the other hand OH and I bought a couple of sofas from DFS last year and we've had them back 5 times to put more stuffing into the seats and the backs as they keep going saggy. Goods you buy must be fit for the purpose you buy them for and I am sure sofas are meant to last a good few years. Even DFS guarantee the frames of their sofas for 5yrs so I'm sure M&S must have some sort of guarantee too.

We had a faulty sofa once,not from M&S though,but from John Lewis.

Not only did they give us a new one with no quibbles at all,but they changed the other one & the armchair too,so they would all match :)

Like you,it was about 2 years old.

Phone them up & explain what has happened...I reckon you have a good chance.

Do you have the receipt still?
