Rotten ebay day - update!

I can only echo the others, its sold as seen and he can't possibly have contacted Trading Standards over a bank holiday weekend surely?

 

Besides which he needs a car anyway so he can transfer the insurance to a new car surely?

 

Most people on ebay wouldn't have even let the guy have a test drive, he bid to buy not to look!

 

I sold something in a small ad then someone found a 'fault' later, they contacted a solicitor who told them they didnt have a leg to stand on - buyer beware and all that..

 

Don't let this loser ruin your weekend :twisted:

I think me smells a rat...if he is worried about his £100 excess etc LOSS sounds just like he wants some more £££ from you.

 

Dont refund him. Dont contact him anymore and lastly dont be upset. He is a trying his luck.

 

We had a bad car experience on ebay but it was our first bad one (not our fault..there was a scam going on)most of the time fortunately the people I have dealt with are top bananas. I think you have been most reasonable just keep all your correspondances.

 

 

Your car is sold.. forget it, even if he turned up on my door step I wouldnt give him his money and call the police again if you think he is trouble. They really wont mind, they are there to protect us.

 

Enjoy the rest of the weekend..you will be fine.

Funny thing just happened...a friend who I have not known long telephoned and asked if she could bring her grandson over on Tuesday to meet the chickens. I said that I wouldn't be able to as I had a big problem and had to go to CAB on Tuesday. She said that she used to work for CAB and was there anything that she could do to put my mind at rest. I explained and she asked if she could get back to me as her husband is a solicitor!

 

He called me back and I do feel so much better now.

Oh poor you! Really try not to worry he sounds a real prat to be honest! He cannot have found a fault that quickly if it wasn't there when he test drove.. ultimatly this is a second hand car from a private seller which was sold as seen.. in court there just would not be any fault on your side.

Trading standards would not be interested as you are not a business, he was given chance to drive and inspected the car and decided to buy of his own free will. You have not given any kind of warranty and offered a more than generous solution.

 

This person has then had a free weekend motoring! I'm glad you have logged with police and it is very unlikely to have insured it and could have clocked up tickets etc.. the other thing to consider it that he could have damaged the vehicle while in his care, he's used fuel and oils etc and the clutch could easily have been damaged by his driving in a very short space of time if he is unfamiliar with the biting point and was racing the engine when cold..

 

Chin up, and if it does coome back make sure you inspect and drive it first before handing any money back!

We often sell vehicles,& once Had a similar experience with a motorbike. .......the buyer told us he was unhappy after having it for 2 weeks. He wanted a partial refund as he reckoned he had paid too much.Classic case of bidders remorse!

 

We pointed out the fact that he had looked it over here,paid for it & clocked plenty of miles too.

People tend to think that Ebay sales have different rules,but its the same as any other second hand sale, with no real comeback.

Says it all. You did not 'hide' any faults you were simply not aware of them IF, (and thats a a really BIG IF) they are even real faults which I actually doubt.

 

He is trying it on.

 

He is a git.

 

Don't let him get to you. You have Omlet power behind you, total suport from us, some great info from your CAB friend and the police and your hubby.

Hi Janty, sorry to hear about your horrible experience.

 

You know you were honest about the car so try and not let his nasty comments upset you.

 

It sounds like you have dealt with it really well and hopefully you won't hear from him again

It's the fact that once the police were mentioned, we haven't heard another thing that rings alarm bells with me. I am going in to see CAB tomorrow morning and then I will write another e-mail and send off the documents.

 

My friend in traffic is going to pass this onto their station to investigate tomorrow as well. I almost feel sorry for the bloke....almost. If he is dodgy (and I have tried to think about all possibilities and that is the only possibility I can think of as he won't accept my refund) he must wonder what he's started.

 

Hubby says to just leave it but I think about how much anguish he caused us and the fact that he could do this to other people who haven't got the combined forces of Omlet on their side or friends who are in traffic police, CAB and solicitors. My friend is going ask the powers that be to check he isn't banned (hadn't thought of this) and if he has insurance. Friend also has a copy of all e-mails to take into work with them.

I know how you must be feeling. I would be beside myself if this happened to me. There is nothing worst that someone accusing you of being dishonest. I found this on eBay's 'Safety Centre "Where the seller is a private individual, the goods must be “as described”. The goods are not legally required to be of “satisfactory quality” or “fit for purpose”. - so legally it looks like your buyer does not have a leg to stand on and in terms of your integrity you have offered a refund so although I know you wont, you should try to relax a bit and see this for what it is - a bit of an idiot either trying to pull a fast one or someone that regrets their purchase :roll::) The eBay safety pages are here:

Janty, what is his feedback history with Ebay,just out of interest?

 

I am wondering if he has a habit of doing this.............

 

I know that sellers cannot leave feedback for buyers now (so wrong!), but you will be able to see what he has bought & what feedback he has left for others via his feedback page.

Janty - just read this thread - am so sorry you are having a bad experience - but you have done nothing wrong! I have both bought and sold vehicles on e-bay and it is a known gamble! Don't lose even a moments sleep over this joker - he is absolutely trying it on. The fact that you have given him a test drive etc...and he has bought it off e-bay - trading standards would laugh at him.

You have to accept that some people out there are not as nice as we would like to think them to be - and nothing you can do will change that. It's not worth getting stressed over - thats what these people are banking on (literally!).

Put it behind you - let him leave feedback if that gets him off and don't contact him again - thats my advice x x x x

I agree caveat emptor. There's nothing to stop him taking out the good bits and replacing with bad - which is what a local garage did with my Volvo when it had been written off (not my fault - a bloke was driving on the wrong side of the road) - although it was done with my permission first. So really you don't want it back either - if you do, you might want an independent person to check it over for you - RAC for example. I think he's a cheeky so and so - for want of better words if you know what I mean. :evil:

Told my OH about this and he said similar thing happened to him a few years ago. He sold car to young man who drove like an idiot when he took car for a test drive then phoned a couple of days later and complained because engine had blown up and claimed OH must have known about it. He was politely told to go away and learn to drive properly. :lol::lol:

 

Sorry you've had such a horrible weekend Jan, people like that see nice, honest people like you as a soft touch and someone for them to take advantage of. If he gets in touch now I would tell him the offer of a refund has been withdrawn as he didn't take up the offer straight away. I hope his nasty little tricks run round and bite him on the bottom :twisted::twisted:

That is not a lot of feedback. He is lucky to have been able to have been able to buy a car from anyone on eBay. Many wont sell higher value items to someone with such little feedback. I would have a look at what else he has bought and perhaps email a previous seller to see if they had any problems that they could not put into the new feedback system. I think that there is a high possibility that he has bought cars previously but under a different user name. He is sounding more and more like a scammer :(

My reply :

 

I have not been dishonest...I have offered you a refund in full. The police have only been informed because if you accepted our refund and the log book had not been sent off then we had to cover ourselves. We were just following advice given by a friend in the police. The reference number given by the police was to cover ourselves if problems occured. As you are now keeping the car I will send off the log book tomorrow and I expect to hear nothing more from you at all as we have been more than fair offering to refund you the £435. I have not made a complaint against you personally to the police...I have just given them both our details and your details in case of any traffic offences which might take place whilst you were in posession of the car in case the log book was never sent off and you were not keeping the car.

Do not accuse me of being dishonest when I have offered a full refund on several occasions.

You took the car for a test drive and although legally I do not have to offer a refund to you, I have done.

I wouldn't get into any further dialogue with him. He is obviously a sad little person who gets some form of enjoyment out of it all. Far better that you just ignore him, but if he continues to harass you, let the police deal with it.

 

In the meantime, big glass of wine and some chocolates :D:D {{hugs}}
