Cinnamon
Thought someone might know.............. My daughter has just moved into an apartment complex in Reading, where she has an allocated parking bay & a permit to display. However during her first week there on a windy day a gust blew the permit further down her dashboard, so it was partly obscured, & the firm employed to police parking on the complex gave her a ticket for failing to correctly display a permit Not a cheapy either - £60! We appealed, but it was dismissed & she still has to pay. BUT we have heard that they cannot enforce payment of tickets on private land any more - is this so? It does seem terribly harsh as she was in her bay, & it wasn't really her fault that the permit was obscured
Egluntyne
Let them take her to court. I think they have to prove that they have suffered a loss because she legally parked in her own bay. Which they won't be able to do. Also their court fee would make the whole thing not worth the time and effort.

Luvachicken
I don't know the answer but that seems very unfair to me.
Charlottechicken
I don't know the answer but that seems very unfair to me. Same here However, I have come across a couple of forums which might be able to help you. One is the pepipoo forum, there is a section on private parking fines, and the other is the moneysavingexpert forums, again, they have a special thread about private parking fines. I agree with Egluntyne though, thought they had to prove they had suffered a loss to successfully claim the fine is justified.
soapdragon
Surely the fact that she has an allocated parking bay and was parked in it means that she has done nothing wrong? The company is nitpicking and using bullyboy tactics to get her to pay up! Hope you get it sorted out in your daughter's favour! Um, just had a thought....if she has a permit then did she have to give her reg number to get the permit? If so and thats the car that was parked there then I cannot see any argument

BraveSirRobin
We had this once, my hubby bought a parking ticket and for some obscure reason put it on the curved part above the dashboard we came back to a penalty notice because the ticket had dropped to the seat (there was a lively discussion of his mental faculties all the way home) we took a picture of the ticket on the seat and sent it in, told them repeatedly we wouldn't pay as we had purchased a ticket and see you in court. They conceded.
Cinnamon
Thanks all - she has decided to brazen it out & see what happens! I will keep you posted.
soapdragon
Good for her! I woudn't mind betting that, once its obvious that she isn't prepared to be bullied and intimidated, they will back down!

Plum
Happened to me when my permit slipped down a bit and only half visible. I sent a photo of the complete permit and was let off. Worth a try?
Cinnamon
We included a photo of it in the appeal, to no avail sadly.
soapdragon
What is the next step then Cinnamon? Was the appeal just with the parking company or the landowner? It will cost them to take this to court etc so cannot imagine that this is a route they would go down unless they KNOW they can win and its really quite tenuous. Cinnamon
My daughter is ignoring them. So thats the next step - flinging a deaf ear in their direction!
Cinnamon
This is still rumbling on....they have engaged the services of a debt collecting agency now. My daughter, who suffers from anxiety issues, is really worried & upset by it all. The last thing she needs is debt collectors at her door....makes me so angry!!! They conceded. That's awful news Cinnamon - they really are scumbags BraveSirRobin, I've had two similar experiences - my car was a left-hooker and so the sticky ticket was fixed to the driver's side window, but teh Derby City Council employee couldn't see through glass and gave me a ticket. That one was squashed easily by showing the ticket. The second time was when Birmingham City Council employed a bunch of scooter boys to stick tickets on. They gave me a ticket five minutes before the cut-off time to move (cars had to move from the street by 7.45am and it was 7.40am) and they even marked the time wrong, as 7.40am! It's a problem of 'by the book', knowing they get rewarded by fining people. I really hope it goes well for your daughter Cinnamon!
Luvachicken
I'm so sorry for you and your daughter that the problem is still not resolved. Here's to hoping it doesn't take much longer.
Charlottechicken
I'm so sorry for you and your daughter that the problem is still not resolved. Me too However, as has been said previously, if the car park is paid for out of rent and it is your daughter's space anyway, how can they possibly say they have been financially disadvantaged to justify this action? Madness Hope this gets sorted soon.
