Update - council complaint

7 weeks ago I posted "I'm so angry - please help" on here about the bloke at the back of me complaining that the chooks were disturbing his 'lie ins'. I've had the chooks for 2 years. As you will see, if you read my previous post, they are not particularly noisy just the normal clucking sound. This caused a great deal of upset for me and my family.

 

All my immediate neighbours were incensed that this man had done this and gave me letters to give to the council saying how much they enjoy the chooks and that they were not noisy - half of them didn't even know we had them.

 

Monitoring forms were issued to this bloke (can't tell you how horrible that is knowing that someone is monitoring you) to fill in.

 

Well it's now nearly 8 weeks on from the complaint and I have just had a letter from the council saying that no further action is being taken, as they have not had any of the forms back. Oh, could this be that there was nothing to complain about in the first place!!

 

It makes me so angry that some people think that they can dictate to others and have got to have everything their own way. I am a very considerate person, always have been - but I shall no longer speak to this person, after all the trouble he has caused. However, I never forget things or how I'm treated by people!!

 

All my neighbours think he's a berk and the council, when I rang them up on several occasions, told me 'not to worry' as they get this a lot.

 

Thought I'd write this in case other people are going through the same.

Hey Karen,

I hate people like that - nothing better to do than try to make other people feel bad.

Ive in a new area and will be getting chooks in the new year and I just hope that the neighbours' don't kick up a fuss.

I haven't really met them properly yet - so finger's crossed theyr nice!

 

I bet your relieved it over, but if your anything like me I bet its been sleepless nights and stressing out everyday since you got the letter. At least you can rest easy now and not be on edge everytime your chooks make so much as a peep.

Karen, how wonderful this is all cleared up now. It must have been awful to have this hanging over you for weeks.

 

On the plus side it must be heartening to know you have good neighbours who are willing to put pen to paper in support of your chooks. It's nice to know that people are tollerant and willing to help each other, even if this 1 person is the exception.

Hi - I know its a worry when you get this sort of letter from the Council but they send a standard letter advising you of the complaint - and they send a standard one to the complainant to say "fill in log sheets for 3 weeks minimum and we'll assess them to see if we consider there to be a statutory nuisance under the Environmental Protection Act 1990". So even if he had filled them in the officers then read them and see if they think there is any sort of justification - I am sure there was not in your case. If you had a cockeral it might have been different.

 

If the logs show that there might be a problem they ask them to continue to record them and do a visit to the complainants property to see how bad the problem is. I cant beleive your chickens are noisy enough to be causing a problem (unless you have a cockeral that crows at 4.00am that is!)

 

The logs and the visit are then viewed as to how the noise would affect the "average person" ie if the complainant works night shift and the chickens are clucking in the day - only an average amount that wouldnt affect "the average person" - then tough luck.

 

So rest assured the fact that he didnt return them means that when he came to fill them in he realised that he had nothing to complain about! Its a shame he has dented your confidence.

 

My ex-batts arrive in a couple of weeks and I am definately not worried about noise but I am making sure the hen house is on paving slabs to discourage rats from digging under it!
