Chicken Stolen!

Quick update I'm afraid!

Whilst I was up the road posting the notices through the doors, a family called at my house. When I got back they were still there talking to my hubby. They had seen a chicken head down the footpath & some other bits. Hubby went and has brought her head back, just to show me it was her. Otherwise I would not have accepted it true. So she had been stolen for fun, escaped & then an animal has had her. I presume she was alive yesterday & got ate last night. R.I.P little Frenchie - you died at someone elses expense, fun & stupidity. :cry:

So sorry this was not a happy ending :( ,

 

I hope some people learn about the consequences of their drunken actions. Perhaps your notice was ripped down because they couldn't face the shame they felt and it's easier to feel angry. It will sink in and eat away at them. Especially when their work colleagues are all talking about the story in the paper and how horrible those people are who did it, and inside they'll know it was them.

When we went to work today - very short walk to our unit..hubby got a text message.

He showed me & it said the following...

 

Feel free to come round and discuss my stupidity any time! :shock:

 

Shame they forgot to withold their number, which has now been given to the police! I think that text is mildly threatening don't you? Our numbers were on the original notices, to help us find Frenchie.

 

We shall fight these lowlifes all the way to the court & beyond if we have to! I hope we hear more from the Police.

probably just some stupid kid playing silly games when they saw your number on the poster? I do hope the police can get to the bottom of this for you. Have they spoken to the host of the party yet? Seems to be the logical place to start.

The police have just been our house. The mobile number is not anyone living at those flats - the police said, but they do know who is it & he is known to them. He is obviously something to do with the flats - boyfriend or something & a bad one. We think he went the party - or it's a wierd coincidence it was the same night.

They can't have him for theft, because Frenchie could have ran out of the shed herself. He has to admit to doing damage to the lights, because no evidence that it was him. Tresspassing isn't a crime. So probably, he won't get done.

Basically, anyone can come in your garden & let your pets out & there is nowt you can do about it!

 

We do wonder if it is the lad who did our burgulary a few years back, who lives very nearby. He would have been out of prison around August time. Our burgulary was December.

Someone doesn't like us & I don't know why!

Not nice cirumstances either...

 

I lost 5 of my chooks to some 2 legged nasty this year...

 

I do wonder when morals, sensibilty and respect left the UK...

 

Things have just gone from bad to worse here...

 

Some adults and kids seem to care less about anything....

 

property, pets, people or belongings...

 

Willfully destroying stuff or causing other upset to people...

 

Its these few that make life miserable for the rest of us...

 

Its not fair that its the caring people who get to suffer the most...

 

 

I'm starting to dislike xmas (the party season)...

 

Things always go wrong for me and others at this time of year...

 

Too many drunks...too many people desperate for money at any cost...

 

Too many reckless people without a care...

 

 

I do believe in "what goes around, comes around"...

 

I hope this is the case for those involved....

 

 

Please take care...and our thoughts are with you ...

That's just adding insult to injury. :twisted: I can't imagine how you must feel knowing these people are able to send insulting texts and go into your garden and there seems to be nothing that can be done. I'm so sorry about the whole situation, but don't think there I have the words to offer you real comfort; just know there are more good people out there than idiots.

My goodness there are some mindless idiots in this world, thankfully too though that there are some lovely ones to stop us giving up hope (all of which seem to keep chickens and post on this forum).

 

Have been keenly watching for news and have only just read that the outcome was not a happy one. Emma I'm so sorry that you have had such an horrific time over Christmas and truly wish you a very much better start to the New Year. Hxxx

I think the police are wrong about the trespass situation! Obviously it's not illegal to accidentally trespass, but tresspassing with the intention of committing a crime is illegal.

 

There are also torts for trespass to chattels and trespass to the person. In most countries it is classed as an "intentional tort" (you need to intend to have trespassed to be held liable)

Maybe someone with more legal knowledge could advise or you could take out a private prosecution? I wouldn't always believe what the police say! I suppose it all comes down to proof, can't they take fingerprints from the shed or something? Doesn't sound like they want to do anything :evil:

ditto! I keep thinking how I would feel and I wouldn't let them brush it under the carpet, they need to be more proactive and look for evidence! I suppose they don't think it's worth their time but what message does that send to the lowlife scum, they can go around committing 'petty' acts and get away scot free!

Emma i really feel for you.

 

I was going to get my chickens and keep them in a firends garden until I finished uni and had a house of my own but I had to stop that plan because I don't trust the people in the area where she lives.

 

My christmas ruined thread in the Nesting Box has more details but I know who you feel when its as if your being punished or hurt by these people and targeted on purpose although you have done nothing wrong as this is exactly how my friend is feeling at the mo and to an extent me as I was staying with her at the time. I just couldn't bring the chickens into that situation because I couldn't live with myself if they got hurt.

 

((HUGS)) to you - why should you have to feel like this in your own home.

 

In my understanding trespassing is a tort so is a civil wrong as opposed to a criminal one so you could take people to court if you knew who it was although it is supposed to be tough to prove so basically you could go to court to sue or get an injunction (to stop them coming onto your land). Think thats right - its what I remember from last year in a nutshell anyway

I'm so sorry to hear all of this Emma - its sad story of nasty people. Poor Frenchie. Are you sure it was an animal that killed Frenchie and not these vandals? If there was blood on their clothing then maybe the RSPCA would prosecute them and stop them ever keeping animals.

Well I can't say I am totally shocked :twisted:

 

Low-life scuzzbuckets can pretty much do as they please. It must drive the Police up the wall.

 

Just count yourself lucky Mr Scuzzbucket didn't hurt himself whilst breaking into your property and murdering your pets or they would have arrested you for assault.

 

There is something rather seriously wrong with this country and it will only get worse as long as the Muppets are running the show. By 'Muppets' I don't mean any particular political party but ALL of them.

 

I hope your luck changes for the better soon.

In my view, the police are wrong to say that they couldn't prosecute for theft. The fact that Frenchie could have escaped from the shed by herself doesn't necessarily mean that the culprit is not guilty of theft. The real problem here is lack of evidence, I'm afraid. Sorry to sound so negative, but it sounds to me as if there isn't much for the police to go on at the moment, and the same applies to civil proceedings. I really hope that some more evidence comes to light although, even if it does, I am not very optimistic that the villain will get what he deserves.

I am so sorry that you have had this nasty experience.

 

Unfortunately all the evidence I can find on the internet shows that:

 

(1) Trespassing in someone else's garden is not a criminal offence, so "Trespassers will be prosecuted" notices are just idle threats.

 

(2) Only if you are deliberately causing damage can the police intervene and prosecute for criminal damage. I imagine that this would be hard to prove in the case of someone opening the unlocked door of a henhouse.

 

How easy would it be to design a lock for the Cube and Eglu eggports, I wonder? I feel worried at leaving my sleeping hens so accessible at night. You would only have to use the lock once a day, when you went to collect eggs.

 

Don't even think about putting down anything designed to trip trespassers up or worse, or else you are the one who will be prosecuted.
