Eviction underway - Start court proceedings tomorrow

Well tomorrow is the deadline for my non paying tenants and then I start court proceedings.

 

I did think they were going to go, her brother told my ex I was evicting them and they had to be out this week. Of course they had until tomorrow to pay up before I started court proceedings. I suspect the interfering busybodies Helpful volunteers at citizens advice may have told them that if they want help with housing they should sit tight until eviction as otherwise they have made themselves voluntarily homeless.

 

Court takes 4 to 6 weeks but as its nearly xmas that will be longer. :(

 

Meantime I pay the mortgage and they live rent free - I suspect I will never get the money back either as I don't have an address to trace them down after they go (she moved out of a property she sold).

 

So far I've managed to make enough on Ebay to avoid a loan but I've applied for another credit card with an interest free period to borrow on and if its not sorted out by the end of that period I'll have to get a loan.

 

Oh and please don't tell me that this is their "home" and I'm heartless trying to evict them and their kids right before Christmas - I don't expect anyone to pay my way and if I couldn't make my payments I wouldn't sleep a wink.

Good for you.

 

I'm sure that if they had come to you andexplained that they were in difficulty you would have come to some arrangement, but as they didn't....well...it's their own fault.

 

As a single parent you have to think of your own child and his security.

Yep still not a word out of them. Not one response to any letter. Only reason I know they are still there is that the neighbors are going to call when they seem them going.

Thanks - its another example of the law being an ass

 

They don't pay rent but cannot be considered homeless until they are evicted. So they stay my problem until the laww gets its ass in gear! Only then does the LA have to find housing for them.

 

Mind you I'm only guessing this is the route they are following, their silence is deafening. I COULD insist on going round to inspect the property but I don't want a confrontation with them which could be twisted any which way in court.

Keep your business head on and look straight ahead if anyone mentions Christmas :evil: How dare they assume that because you have a house to rent out that you can afford to cover their housing costs! I hate people who make assumptions about others wealth.

 

Stick with it Penguinmad, they are, in effect, thieves :evil:

Go for it Penguinmad, I don't have a problem with you starting eviction proceedings before Christmas - the simple fact is THEY haven't paid you - I bet they will find the money at Christmas for their kids presents.

Hope you manage to keep your finances afloat without too much hassle.

Thank you all - I posted this on here because over at Money Saving Expert you get great advice BUT you also get loads of bleeding hearts saying "remember its their home".

 

Actually its MY house and I welcome tennants trying to make a home out of it but I was brought up to believe you have to PAY to have a roof over your head.

 

I hope this all ruins their Christmas. Maybe Christmas morning would be a good time to pay a visit.....I may have to take James over that way to see his Dad.

Demanding ones rights is fine so long as they accept that rights go hand in hand with responsibilies :evil:

 

We had 15 months of having a mortgage and a bridging loan - but that was our choice - and it was a killer trying to keep all that going. This situation is being forced on you - stick to your guns!!

I regularly have to attend court to evict people as part of my job. It is never easy but there are some people that wind you up so much that it is almost a pleasure :oops:

The LA won't house them as they have made themselves intentionally homeless by getting into rent arrears. Make sure you send a letter to your local Council's Housing Needs department stating the name of your tenants (and DOB if you have it), the condition they left the property in and the level of rent arrears you were left with. Please ensure you ask the judge to award costs. He should be willing to do so. You also want a money judgement awarded against them so that they have to pay the money back to you - and it affects their credit rating. This should also show if they go for a private rented property through an agency and a credit check is done on them. The people who liaise with you and try to reach an agreement are not the problems. It is the ones who pretty much stick 2 fingers up at you.

 

I have just had another abandonment - I only found out because the HB stopped - she apparently set up another tenancy 3 weeks ago. This really annoys me because it takes nothing to return keys through the post - I always say at the start of any tenancy - if you do go at least have the courtesy to return the keys as someone else needs this place as much as you did - sometimes water off a ducks back.

 

I wish I had seen this post earlier. Do you have a solicitor? If not by all means pick my brain - I have been doing DIY possession for 5 year now. I am PM-ing you my mobile number x

Why should you have a pants xmas becuase they are spongers. If you could (And it wasn't going to ruin your day) I would evict them on christmas day. Like others have said it's just a day. Say you are an atheist or Jehovah's witness and you didn't think about the day as you don't celebrate Christmas.

Good luck Pengy. I'm sorry I can't offer you any advice.

 

There have been times in my life when I've had 3 jobs at once to keep up with all my financial commitments. It would never occur to me to not pay my rent or any other money due. Why do people think this is acceptable?? :shameonu::evil: I hope it all goes smoothly and swiftly for you, i really do.

I filled in all the forms and Mum went took them to the court on Thursday 8th November. In the middle of a lesson Mum called to say the court lady who is "not allowed to give advice" said I should use the accelerated procedure, I did not think I was able to but the woman "not giving advice" insisted.

 

I didn't have time to put together a different pack until the weekend so the accelerated procedure went in on Monday. Not heard anything by today when I thought they got posted out the next day or so so I called. Its been thrown out by the judge and is on its way back with explanatory notes and my money back. I need to use the forms I filled in originally but now I've lost a week. I'm off work sick so I'll take it down there first thing - forms are already filled in I just need to print off more copies of the information to put the packs together again the same as the first time.

 

I guess I'll just have to sell more Wii's - mind you they are getting very hard to find now.

I am psychic....Him Indoors has just mentioned something work related that we have not spoken about for ages....just as I was about to open my mouth to say the very same thing to him.

 

I do it all the time....and with colleagues and friends. :shock:
