I couldn't find a link - it was a solo advert in The Warrington Guardian with Frank Marshall. I did look on their website this morning but couldn't find anything listed.

hmmmmm how to persuade Mum to move to another part of the country and live in a mobile home???? Hey with the change from this place we could build her a little bungalow!

 

Now of to TES jobs to see if I can get a teaching post nearby!

I think this MIGHT mean that the property has an agriculatural tie on it.... but, one way to find out!

 

Just what I was going to say as well - some local councils make it difficult to comply with an Ag.Tie as you are supposed to earn your main income from the land - inpossible from 3.5 acres so you'd need to have a job elsewhere, but still in in agriculture, as well.

Our Ag.Tie applies to me which means that Carl is able to continue his work - which pays the mortgage - and is why all my family and friends have to pay for their eggs and meat :lol:

Definatly agricultural tie on this. It is difficult. We have looked at lots of property in this catagory. I know for a fact the owner has another business as he is in the same line of work as me and its not agricultural. I wonder how that works out??

 

I have not looked into the laws of ag. tie properly. Does anyone know if there is 2 of you say a married couple, if one of you works the property as a source of income would it make a difference if the other person sourced income from outside agriculture? Would the income from the agricultural business have to be the greater income.

Could be difficult just selling a few chooks.

People do ignore agri-ties, but IMO it's pretty unfair to do so; the agri-tie is the reason why someone is allowed to build on green-belt land - not to allow a cheaper way of getting a rural prperty, but to enable rural workers to conduct their businesses. After all, if we were to allow everyone to build on agricultural land, we'd have none left!

Our council seems to overturn agri-ties at the same rate they grant permission for new builds with agri-ties (you'd think they'd realise whwat was going on...), and are incredibly naive over it ("yes, of course you can make a living off 10 acres of windswept badly drained bog with no natural water supply which has only ever been used for low-level grazing up till now, even though you've no experience in farming. After all, those which have been farming for years/generations struggle becuase they aren't doing it right! Oh, and you need/can support a 6 bed house too? And you "need" 5 bathrooms? No problem, go right ahead!"). Sorry, rant over.

 

The wording can vary, but MOST insist on the majority HOUSEHOLD income being from agriculture/horticulture/forestry. You can usually value own-use produce though. But basically you have to be earning the majority of the household needs/income from something which means you have to live on that particular area in order to conduct your agriculatural/horitcultural/forrestry business. It possibly could be done on 4 acres depending on location, climate, quality of land, cost of upkeep, experience and commitment of person doing it, what was being done, though I think it would be very very difficult. Arguably no permission should have been granted to build with so little land attached, but this would have been the result of the owner of the land fighting very hard for it and not the council being unreasonable. (Sorry, ranting again!).

Planning and Conditions

Planning consent was granted by Vale Royal Borough Council in 2004 under APP/2004/1566 for an agricultural worker’s dwelling (log cabin). Detailed planning consent was obtained in November 2007 under Vale Royal Borough Council’s Reference 07-1711-FUL. The develop-ment is covered by an agreement under Section 106 The Town & Country Planning Act 1990 whereby the present and future owners of the site are bound, so that the site of the house and the adjoining land (on both sides of Roddy Lane) remain as one agricultural unit and that the dwelling house “shall only be occupied by persons solely or mainly employed or last employed in agriculture as an agricultural worker as defined in Section 336 of The Town & Country Planning Act 1990 or a dependant of such a person residing with him or her including a widow or widower of such a person”.

 

Copies of the planning consent and the Section 106 Agreement may be viewed at the offices of the selling agent by prior appointment
