Absolutely Gutted!!! sorry Long Rant! **Update**

I know it seems like the end of the world, but try to stay positive. I was made redundant from a job even though I was well liked by my bosses and had excellent reviews in writing. However there was another girl who had bad reviews and complaints from her managers but who kept her job. How crazy is that? Also another girl requested voluntary redundancy but was refused. I felt my world had come to an end, unloved and very bitter. Lots of wine that lunchtime and cried all the way home on commuter coach

 

All I can say is stay positive. One door closes and another opens. Because of my age none of the financial companies wanted me, not even an interview so I temp'd. After a few months I was offered a job with the company I was temping with and also finally managed to get an interview with a totally different firm. Something told me to accept the other role and I haven't looked back. Been here now for nearly seven years. The people are great and I thank JP Morgan for dumping me as I've had a better quality of life since.

 

Stay positive and if need be temp for a while. That way you get to know the company and they can see if you are a worker and then more than likely you will be offered a position with them.

Thats a shame for you but I am going to be contraversial here and say that a fixed term contract is just that, any reassurances and promises are just words sadly :(

 

Yes Redwing you’re right however what makes this an interesting senario is I have never had a written Job offer or Contract and never resigned my previous post.

 

I received a copy of the Job Offer I should have got in August today it asks me to sign allowing them to make changes to my contract and even that they managed to get wrong as my base location is incorrect as is my L weighting.

 

So its back to the books to check :evil:

Again Redwing you are right If you do the same hours in a job for more than six consecutive weeks it is accepted in law as a contract, But my argument is that I have only been working from a verbal contract and that my boss told me that he would not ask me to apply for the post if he didn't expect it to be made permanent as I said I have never seen let alone signed anything.

Six new permanent posts have been advertised one of which is similar to my current & previous role and is the same pay albeit back in Luton where I started I intend to apply tomorrow I have to let my manager know as a matter of course. This gives them an option offer me the new post and all will be fair in love and war however If they want to test it out the legality of the alleged never issued, unsigned fixed term contract at the ET fine let the ET decide whether it is likely I would leave a 22.5k permanent post for a alleged six month contract.

 

Given the time & expense of defending a claim at the ET I previously ran a DDA & Unfair Dismissal claim and won on 5 counts (which my current employers are aware of ) that cost my ex employers 65K to defend only to lose I know which one I would choose.

 

I realise this makes me seem like a trouble maker I am anything but I simply will not let someone do this to me when I haven't done anything wrong :!: in fact I always said I would never put myself through the stress of anything like it again . But if they leave me no choice :(

Just an update for anyone who may be interested in this original topic or anyone in a similar position with there employer.

Honesty & Persistence wins the day I lodged a claim for unfair dismissal and less favourable treatment with the Employment Tribunals against my former employer some months ago after a pre hearing review a final hearing was scheduled for March 2011 following much correspondence and wrangling over the disclosure of documents between myself and their solicitors We have reached an out of court settlement I still don't have a Job but at least financially I can pay off a significant chunk towards our mortgage and that is a good feeling not having to go through the stress of a four day court hearing is also a relief.

I have no plans to return to work at the moment as my health which was poor in any event has deteriorated significantly in the last eleven months instead I am considering some voluntary work of some sort just to get me out of the house and keep me semi sane.

The moral is If you know your employer is in the wrong dont give up fight back.

I have to say, well done for being so brave and fighting your corner - especially as you had been through the stress of a similar awful situation before.

 

I had a hideous employment experience in one of my first jobs - I, along with most of the other employees, was treated very badly and cheated out of a lot of money, never mind the stress and misery it caused. I never managed to pluck up the courage to take things further as the stress of thinking about it was too much. Others did though and got thousands of pounds each in compensation when the matter was investigated.

Well done, you have some justice :clap: . Take care with voluntary work it may invalidate benefits. Hope your health picks up this year

 

Thanks Plum I don't claim a single benefit so have no worries there. I have a disability and long-term health condition which as we all know sadly just gets worse with age but on the plus side I have a wonderful OH who has been a rock and supported me wholeheartedly throughout and isn't bothered in the slightest if I cant work :)
