The Dogmother Posted April 17, 2017 Share Posted April 17, 2017 Oh well, it was such a lovely weekend, that something was bound to spoil it.... Was parked up outside my house - quiet Victorian side road with on-street parking, waiting for this white van to pass so I could pull out; anyway, he ran into the side of my car (no idea why as he had plenty of room to pass) has completely mullered the side of my vehicle; expect it to be a write-off, and broke my finger as it was caught in the steering wheel. He drove off, leaving part of his van's trim under my car, but I got his reg. Thankfully he is insured (with the same company as me!) I had thought that he drove off as he wasn't insured. Police and insurance now have all the details, photos etc and i am leaving them to get on with it! Tell you what, the finger blumming hurts! They are wondering if he was drunk or on his phone when he hit me as he obviously wasn't looking. He will be invited to present his documents at the station, and the police are keeping me informed. In the meantime life goes on... I had this week off to gets lots of work done on the house, but I am going to be slightly limited by this injury. In Germany, you almost certainly lose your drivers license, if you leave the scene of an accident. A friend got a scratch on her car (nothing major) when the car was parked. Someone saw who did it and reported it. Police came to the "scene" and took lots of photo's and even a sticky of the paint on the scratch! Don't expect anything like that in the Netherlands! Love the phrase 'invited to present his documents'....so polite If there is suspicion that he was on his mobile then its perfectly possible to check his 'phone records and the police certainly should do so under the circumstances. Maybe worth asking your 'investigating officer'? As to the work you were planning to do this week then maybe this is the superior being's (whoever that might be) way of telling you to slow down?! sjp Posted April 17, 2017 Share Posted April 17, 2017 not sure he can be done for using the phone (if he was) as I think it's one of the motoring 'crimes' that has to be witnessed by a police officer, they won't be able to prove DUI as he failed to stop failure to stop and or not reporting an accident is probaley the most he'll get done for if he gets done. it's more than likely a minimal fine and a point or two and unless it a repeat offense I doubt the CPS will take it to court. the injury and damaged is probaley only and insurance job as far as the police are concerned failure to stop in these sort of things sadly isn't that uncommon Quote Link to comment Share on other sites More sharing options...

As for failing to stop at the scene of an accident, the police might summons him straight to court. Since you have received a injury that is more than superficial, the driver may be looking at 7 points, a hefty fine and possible disqualification. Be careful about that - someone (with the same company as me) ran into the back of my car once - admitted fault - but there was some complication (can't remember exact details) as single insurance person/dept. was acting to get the best for both their clients. I had a problem with a head-on accident caused by someone on completely the wrong side of the road. He had the same insurance company so they decided 'knock-for-knock'. The Dogmother Posted April 18, 2017 Author Share Posted April 18, 2017 Thanks all for your advice and wishes Fracture clinic today; they splinted it, which was no use at all as I couldn't even get my jeans down to go to the loo like that!! Phoned up my uncle who is a retired orthopaedic surgeon and he was of the opinion that as it wasn't displaced, then so long as I was careful (how well he knows me! ) I could take the splint off. Much relieved, swelling and bruising going down and now able to take a leak on my own!!! No contact from police or insurers today, but the police did say that they would be inviting him to attend the station with his papers, and would have x number of days to comply. Car looks a right state, but my mechanic looked it over and it's fine for gentle, local trips until things get sorted. The consultant at the hospital did say (off the record) that the compensation for the injury should help towards a replacement car Quote Link to comment Share on other sites More sharing options...

They splinted it up with a plastic thingy, padding and lots of tape, strapped to the next finger. If it is written off, then I am hoping that I can buy it back for a couple of hundred so that I have something to drive while I get another car sorted. sjp Posted April 20, 2017 Share Posted April 20, 2017 he has 7 to produce from the date of notification as for the mobile all the records will so is that the phone was in use at the time and which tower or towers it was near to if the was a 2nd person in the van then it'll hard to prove who was using it unless there's a suspicion of an act of terrorism they won't get a warrant for for much more than they phone was in use at the time and in the currant climate of budget cuts the police probable aren't going to go to far with with in their mind a simple insurance/civil job at the moment all they can prove is failure to stop and driving without due care and attention which resulted in damage to a car and caused a minor injury both of which they'll want the insurance to deal with . long term DM's going to suffer both pain to the finger and pain to the bank balance in the loss of no claims and high car insurance Quote Link to comment Share on other sites More sharing options...

I had my first ever rta last year, when my poor old rover was shunted forward in a stationery queue of traffic by what we found out later was a learner driver on his own in his car. My car was written off due to repairs being more than 60% of the car value ( actually, they weren't as most rover parts are now second hand!) Long story short I was put in touch with one of those third party claim companies who dealt with everything. I was lucky in the fact that I had no income whatsoever at the time and could prove it as these companies give you a hire car at exhorbitant cost to the other party, which I didn't realise. It took months and they took the other driver to court for me to get the money (that is where the no income bit came in handy) and finally got a massive cheque in February, for far more than it cost to repair the car. Took nine months to sort and I had to borrow the money to fix my own car too, but at least my insurance didn't suffer and I got a hire car too, although it was brand new and I couldn't use it to renovate the property I was doing up at the time!
